After hearing senior advocate Abhishek Manu Singhvi, who argued that there was no concrete evidence against Singh and that he was a fit case for bail after six months in custody, the bench asked Additional Solicitor General SV Raju in the pre-lunch session. Section 45 of the Prevention of Money Laundering Act, 2002 states that bail can be granted if the court is prima facie satisfied that the accused has not committed the offense and is not likely to commit the offense after being granted bail.

A bench of Justices Sanjeev Khanna, Dipankar Dutta and PB Varale said that the AAP MP was not implicated by co-accused Dinesh Arora in his opening statements in the case and that Singh’s name came up much later and further, he had not received any money and no money. There was no trail either.

When the bench convened after lunch, the ASG said the ED did not want further detention of Singh and preferred not to contest the case. He said that though the agency had an “arguable case”, it was granting relaxations in view of the peculiar facts of the case and bail for Singh should not be taken as a precedent. The court then granted bail to Singh, while clarifying that it had not expressed any opinion on the merits of the case. He also said that the concession was granted by the ED before it started arguments and would not be treated as precedent.

“Leave granted. SV Raju, ASG, was asked to receive instructions in the morning session. He states that the respondent-ED has no objection if petitioner Sanjay Singh is released on bail pending the proceedings in respect of the offense under sections in the case. 3 and 4 of PMLA, 2002. In view of the statement made, we allow the present appeal and direct that the appellant be released on bail during the said pendency on the terms and conditions decided by the trial court,” the bench said in its order. was

As the ASG requested the court to restrain Singh from making public statements, the bench said it cannot restrain him from political activity.
Arora paid Rs. Singh was arrested by the ED on October 4, 2023, following a statement that 2 crores had been delivered.
